The claimant experienced pain in his lower back and had to go to hospital, attend subsequent doctor visits and purchase prescription medication. As a result of the injury, the claimant had to take a week off work to recover. The claimant asserted that the insured personal trainer failed to properly check the TRX system and sought compensation from the trainer including for the time off work as well as the cost of medical treatment and medications.
The personal trainer’s Public Liability insurer confirmed that the claim was covered by the policy and the claim was settled with the insurer paying the settlement amount less the policy excess.
